CLIENT SERVICE AGREEMENT WITH ART OF TRAVEL

By choosing the services of Art of Travel to plan your vacation, you signify your agreement with the following terms and conditions. Access to and use of the services of Art of Travel. (“Art of Travel” and/or “you/your”) our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“customer” and/or “you/your”) agree to be bound by these terms. If you do not accept all of these terms, then please do not use our services or our websites. These terms and conditions govern the relationship between Art of Travel and you, the Customer. No alterations to these terms and conditions may be made by any Art of Travel employee, authorized representative or agent, unless in writing by an authorized officer of Art of Travel.

Terms And Conditions

Travel Documents: You agree to ensure that your itinerary and other travel documents are accurate and to notify us immediately of any problems. The name on the document must match your government-issued ID.

Agent for Suppliers: Art of Travel. (“Art of Travel”) is a commercial agent for the airline, hotel, car rental, tour operator, cruise line or other service provider (“Provider”) mentioned in your itinerary or confirmation. Works as a store. We are not responsible for the acts or omissions of Suppliers, their failure to meet their own schedules, their provision of services or refunds, their financial failures, or their failure to redeem future travel credits. We have no special knowledge of the supplier’s financial situation and are not responsible for recommending travel credits in lieu of refunds.

Refund of Unused arrangements: Art of Travel’s voyage charges are based on the contract price and no refunds will be made for any unused portion/s of the tour.

Travel and Dismissal Risks: We accept no liability for the acts or omissions of others beyond our control, or for health hazards, illnesses, weather hazards, including, but not limited to, acts of God, dangerous situations, terrorism, pandemics, or the suitability thereof. We are not responsible. Part of the trip for people with disabilities. We have no special knowledge of the hazards while traveling or at our destination. YOU EXPRESSLY ASSUME ALL SUCH RISKS AND RISKS, HOWEVER YOU INDEMNIFY US AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, DIRECTORS, GROUP MANAGER AND SUBCONTRACTORS. AND You expressly agree to indemnify us for any liability. Ability, conduct, cause of action, causes of action, for any current or future claims, allegations and demands of any kind that may arise out of or in connection with any such risks or dangers.

Entry & Re-entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Make sure to note rules are subject to change whether your travels are foreign or domestic. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

Fees and Price Drops: You agree to pay the travel planning, change, and other fees according to schedule of deposits, payments, and cancellation “Schedule of Deposits/Payments and Cancellations” mentioned below. All our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

Reservation Rule Violations: You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a “point-beyond”, “hidden-city”, or “back-to-back tickets”. You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets. If you do not use one of the flights in your reservation, the airline will cancel your remaining itinerary, and it may confiscate your frequent flyer points. You agree to indemnify us against airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

Note: UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS MAY NOT BE INCLUDED IN YOUR TRAVEL PLANS. In such an event, it is the customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. Voya Art of Travel shall not assume any responsibility for any air and/or ground schedule changes. Every attempt has been made to include all taxes in your package. In rare instances, certain departure taxes must be paid in cash only, upon departure from a country, and may vary in price.

Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

Credit Card Merchant: We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

Denial of participation:  Art of Travel reserves the right to deny participation in the tour to any traveler that Art of Travel, in its sole discretion, judges to be incapable of meeting the rigors and requirements of the tour activities, or whose actions or deportment it judges unsuitable for group travel. During the tour, Art of Travel has the right in its sole discretion to remove anyone who it determines to detract from others’ enjoyment of the tour. The decision of the local guide or local supplier is final on all matters that may threaten safety or interfere with the well-being of others.

Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year.

Alterations in travel plans. Alterations in itinerary may be necessitated for any number of reasons, including but not limited to severe weather, at the sole discretion of Art of Travel, and/or subject to supplier terms and conditions. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable one.

This agreement is governed by the laws of the country of Egypt. You agree that the courts in Cairo, Egypt will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

Cancellation and Changes by You

You may cancel your holiday at any time providing you notify the Company in writing. The following charges will be levied on any cancellation, unless another policy is sent with your package confirmation.

30 – 45 days 80% of Tour Cost

1 – 29 days 100% of Tour Cost
